Fundi Moja's websites ("Sites"), mobile applications ("Applications"), and all related content, products, services, information, and communication are collectively referred to as the Fundi Moja Platform.

Your personal data submitted to the Fundi Moja Platform, or collected about you, is governed by our Privacy Policy. By using the Fundi Moja Platform, you acknowledge that you have reviewed and accepted our Privacy Policy.

By registering and using the platform, you accept and agree to be bound by these Terms, our Code of Conduct, and our Privacy Policy, including any future amendments as published from time to time.

You may withdraw your consent at any time by contacting info@sicons.co.ke. However, withdrawal does not affect the legality of any processing done prior to your request.

Fundi Moja reserves the right to amend these Terms. Updates will become effective upon posting. Continued use of the platform constitutes acceptance of the revised Terms.

If any changes are unacceptable to you, or if you no longer comply with the Terms, you must deactivate your account and stop using the Fundi Moja Platform.

All content, logos, trademarks, and intellectual property on the platform are owned by Fundi Moja and protected by copyright and intellectual property laws. You may not use, reproduce, distribute, or modify any content without prior written consent.

3. User Conduct

You agree to use our platform lawfully and respectfully. Prohibited activities include but are not limited to:

• Violating the rights or privacy of others
• Uploading or transmitting malicious or harmful content
• Attempting unauthorized access to our systems

4. Privacy Policy

Your personal data is collected and used in accordance with our Privacy Policy. By using our platform, you consent to this collection and use.

5. Responsibilities of Service Providers

Service providers using the Fundi Moja Platform are independent contractors, not employees of Fundi Moja. Any damage resulting from negligence or criminal activity is the provider's responsibility.

Fundi Moja performs thorough vetting and background checks on all providers and trains them on best practices and professionalism.

To maintain service quality, Fundi Moja may:

• Ban providers who violate guidelines
• Pursue legal action in serious cases
• Provide professional indemnity insurance coverage
• Enforce tax compliance (10% income tax withheld on behalf of the Government of Kenya)

During registration, providers must submit:

• A valid KRA PIN
• Certificate of Good Conduct
• Referee contact details

6. Booking Fees & User Satisfaction

To maintain transparency, the following booking fees apply:

• Tier 1 Services: KES 500
• Tier 2 Services: KES 250

These fees are only charged once the user confirms a service provider match. You can review profiles and make informed choices before any payment is made. Our goal is to empower users and ensure satisfaction.

7. Third-Party Links

Our platform may include links to third-party websites. Fundi Moja is not responsible for their content or privacy practices. Please review their policies before interacting with them.

8. Limitation of Liability

To the fullest extent allowed by law, Fundi Moja shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the platform. We do not guarantee the accuracy or completeness of information provided.

9. Indemnification

You agree to indemnify and hold Fundi Moja harmless from any claims, liabilities, losses, or expenses resulting from your use of the platform or violation of these Terms.

10. Modifications

We may update these Terms at any time without prior notice. You are responsible for reviewing them periodically. Continued use of the platform means you accept any changes.

11. Governing Law

These Terms shall be governed by the laws of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the Kenyan courts.
